Can any relative bring a wrongful death lawsuit?
Transcript
If there’s been an occasion of a loved one or family member dying and I’m asked who can bring the lawsuit? The answer to that under our law is if it’s a wrongful death lawsuit, it belongs, the benefits of that would belong to the beneficiary. So beneficiary can bring it. There is also a legal claim called survival action, and that would be brought by the estate of the deceased person for the period of time and may have suffered and being alive. So the short answer is the beneficiary brings the wrongful death and the estate brings the survival action. Technical questions and it can be legally complicated, so please call us at Peake & Fowler in Columbia, South Carolina.
