What happens if a person dies before bringing a personal injury lawsuit. This would be intermingled or basically what’s called a survival action lawsuit where a person had suffered injuries as a result of the negligence of some third party before the person passed away and their calls of action or their lawsuit survived after their death. And it would be brought out of their estate. The personal representative of the estate would actually bring the lawsuit.
