Types of Disability Benefits

Your Workers' Compensation Benefits MAY COVER LOSSES FROM A DISABILITY

If you are temporarily or permanently disabled, you have the right to seek money and benefits. Don't let the insurance company or your employer make you think you don't! Contact us today for a free case review.

If you are injured at work, you may be able to collect workers' compensation, which provides several types of disability benefits. In South Carolina, an employer with four or more full- or part-time employees must carry workers' compensation insurance.

Your compensation depends on a number of factors, including:

  • Whether your injury is partial or permanent
  • How much you earned for the four quarters prior to the injury (each quarter is three months)
  • The part of your body that was injured

The types of benefits you may receive include:

  • Medical expenses
  • Lost wages
  • Compensation for temporary total disability (TTD) — Injured employees with temporary total disability benefits are eligible to receive about two-thirds of their wage, subject to a weekly cap of about $700. These payments will continue for up to 500 weeks.
  • Compensation for permanent total disability (PTD) — Same compensation as for TTD.
  • Compensation for permanent partial disability (PPD) — Injured employees receive the same compensation as for TTD and PTD, but the payments may continue for up to 340 weeks.
  • Death benefits to a spouse or children if the work injury is fatal

If you've been injured at work, it's wise to consult with a workers' compensation attorney who can help guide you through the process. Insurance carriers may find reasons to deny your claim or stop your benefits prematurely. You have options. You may request a hearing with the South Carolina Workers' Compensation Commission.
