Auto Accident FAQs
Peake & Fowler Has Answers to Your CAR ACCIDENT FAQS
Do I decide who will repair my vehicle? Yes, you can choose where your vehicle is repaired, but insurance companies sometimes only will pay if you get your car fixed at a shop that they approve.
Who pays the fees to store my vehicle? The insurance company of the driver who caused the accident should pay storage and towing costs, according to what is reasonable in your area. If the car is totaled, the insurance company will pay to have the vehicle transferred to a salvage or wrecking yard. You will be responsible for any storage or towing fees if you don't want your insurance company to move your car.
Who decides if my car is "totaled" or repairable? If your vehicle is not worth repairing, it is "totaled." The insurance company that is responsible for the payment can decide that your vehicle is not worth repairing. To be totaled, the cost of the labor and parts is higher than the market value of the vehicle. If you want to keep the vehicle after it has been written off as a total loss, you will have to pay the salvage value to the insurance company.
Who covers the bank loan if my car or truck is financed? You will still be responsible for any money you have borrowed to pay for the vehicle. If the fair market value of your vehicle is less than the outstanding loan, you still need to pay the whole amount of the loan.
